New law on transparent and predictable working conditions: what’s new and how to ensure compliance?

Directive (EU) 2019/1152 on transparent and predictable working conditions aims to harmonise information about essential aspects of the working relationship and working conditions across Europe to ensure greater transparency and safety in the workplace. Luxembourg has just adopted the Law that implements this directive, almost two years late.

To comply with the new legal provisions, one particular step that companies will have to take is updating their employment contract templates. The Law adds a number of additional clauses that must be included in employment contracts and also calls into question the validity of certain clauses. In addition, employees now have the right to request a number of adjustments to their contract, which will also give rise to new obligations for employers, particularly in the event that the requested adjustments are refused.
