COVID-19 legislation: almost all public health restrictions have now been lifted

In our Newsflash of 22 February_, following the adoption of the law of 11 February 2022, we reported on the relaxation of the health restrictions imposed by the law of 17 July 2020 introducing a series of measures to combat the COVID-19 pandemic (in particular, that the CovidCheck regime in the workplace had been made optional and that curfews had been abolished).

Due to the improvement in the main indicators and the epidemiological situation, the Luxembourg government has now relaxed restrictions once again, with the law of 11 March 2022 (the “Law”).

The main changes introduced by the Law are summarised below, and largely cover the abolition of the CovidCheck regime and the loosening of the obligation to wear a mask.

• The CovidCheck regime has been abolished in the workplace except for care facilities (hospitals, retirement homes, etc.) and their staff, due to the high concentration of people vulnerable to COVID-19. Please note that in line with this, the prohibition on terminating the employment contract or imposing disciplinary sanctions for employees who refuse to show a valid certificate under the CovidCheck regime has also been abolished.
• The CovidCheck regime has been abolished in restaurants, bars, cafés and canteens, both for the staff at these establishments and for their customers.
• In addition, the CovidCheck regime has been abolished for establishments open to the public and for gatherings, protests and events. In principle, all members of the population can be permitted entry irrespective of their state of health or vaccination status.
• The CovidCheck regime for use in care facilities remains in place, but has been relaxed from 3G+ to 3G. Lawmakers are of the view that “the fact that these establishments house a large number of particularly vulnerable people justifies selectively keeping in place more restrictive measures than for the general population” (bill no. 7971, 7-8). Under the Law, people with disabilities are no longer considered particularly vulnerable. Thus, sectors affecting this category of the population are no longer subject to specific restrictions.

Access to care facilities is now limited to those who can show that:

• • they became fully vaccinated less than 270 days ago or have received a booster shot, or
  • they have a negative PCR test less than 48 hours old or certified COVID-19 test less than 24 hours old, or
  • they have a certificate of recovery from less than 180 days prior.

In these care facilities, it is no longer necessary for vaccinated or recovered persons to do a self-test on site. However, unvaccinated persons without a certificate of recovery and/or with a certificate attesting to the fact that they should not be vaccinated must still show a negative PCR or certified test less than 24 hours old. Alternatively, they can do a self-test on site.

In view of the vulnerability of those who typically occupy care facilities, the requirement for staff, visitors and external providers to wear a mask has been maintained.

• The public health restrictions on gatherings have been repealed (obligation to wear a mask, obligation to notify and/or obtain authorisation from the Health Directorate, etc.). As a result, masking at schools has been abolished.
  However, masks must still be worn on public transport and in care facilities.
  As a reminder, failure to wear a mask on public transport and failure to comply with an isolation measure are punishable by a criminal fine of between EUR 500 and EUR 1,000. A warning fine (avertissement taxé) of EUR 300 may be imposed for these offences by police officers and agents of the Grand Ducal Police, and by agents of the Customs and Excise Agency.
• The requirement for a health protocol in shopping centres has been replaced by general recommendations for protective and hygiene measures, including recommendations to wear a mask in crowded areas, to practice social distancing and to wash and disinfect hands.
• The health measures for sports, fitness, school and cultural activities have been repealed and replaced by general recommendations on the hygiene and protective measures to apply, including recommendations to wear a mask in crowded areas, to practice social distancing and to wash and disinfect hands.

The Law came into force on 11 March 2022 , the date of its publication, and is set to remain in force until after 30 June 2022.

Législation Covid-19 : les mesures sanitaires sont presque toutes levées

Dans notre Newsflash du 22 février_ dernier, suite à l’adoption de la loi du 11 février 2022, nous faisions état d’un assouplissement des mesures sanitaires introduites par loi du 17 juillet 2020 portant introduction d’une série de mesures de lutte contre la pandémie COVID-19 (rendant notamment facultatif le régime « CovidCheck » au travail et abolissant les couvre-feux).

Fort de l’évolution favorable des principaux indicateurs et de la situation épidémiologique, le législateur luxembourgeois vient une nouvelle fois d’assouplir ces mesures par la loi du 11 mars 2022 (la « Loi »).

Les principales modifications apportées par la Loi sont résumées ci-dessous et portent principalement sur l’abolition du régime CovidCheck et l’assouplissement de l’obligation de port du masque :

• le régime CovidCheck est désormais aboli au travail, sauf pour les établissements de soins (hôpitaux, structures d’hébergement pour personnes âgées, etc.) et leur personnel compte tenu que s’y concentrent des personnes vulnérables à la Covid-19. Dans la logique des choses, il convient de noter que l’interdiction de licenciement ou de sanctions disciplinaires concernant les salariés refusant de présenter un certificat valable sous le régime CovidCheck a également été abolie.
• le régime CovidCheck obligatoire est désormais aboli dans les restaurants, les bars, les cafés et les cantines, aussi bien pour le personnel de ces établissement que pour leurs clients ;
• le régime CovidCheck est également aboli de manière générale au sein des établissements ouverts au public et dans le cadre de rassemblements, manifestations ou évènements. L’ensemble de la population pourra en principe de nouveau être accueilli quel que soit son état de santé ou son statut vaccinal ;
• le régime CovidCheck dans les établissements de soins demeure, mais est assoupli : il passe du 3G+ au 3G. Le législateur a, en effet, estimé que « le fait que ces établissements hébergent, en grand nombre, des personnes particulièrement vulnérables justifie de garder sélectivement en place des mesures plus restrictives que pour la population générale » (projet de loi n°7971, 7-8). Les personnes handicapées ne sont d’ailleurs plus considérées comme particulièrement vulnérables par la Loi et par conséquent les secteurs d’activité touchant à cette catégorie de personnes ne sont plus soumis à des restrictions spécifiques.
  
  L’accès aux établissements de soins est donc dorénavant réservé aux personnes qui démontrent qu’elles:
  • ont été complètement vaccinés il y a moins de 270 jours ou ont reçu une dose de rappel ; ou
  • disposent d’un test PCR négatif datant de moins de 48 heures ou d’un test Covid-19 certifié datant de moins de 24 heures ; ou
  • sont en possession d’un certificat de guérison datant de moins de 180 jours.

Dans ces établissements de soins, il n’est ainsi plus nécessaire pour les personnes vaccinées ou rétablies de faire sur place un autotest. En revanche, les personnes non vaccinées qui ne disposent pas d’un certificat de guérison et/ou qui disposent d’un certificat de contre-indication à la vaccination doivent toujours présenter le résultat négatif d’un test PCR ou certifié datant de moins de 24 heures. Alternativement, elles peuvent réaliser un autotest sur place.

Compte tenu de la vulnérabilité des personnes se trouvant en principe dans les établissements de soins, le port du masque pour le personnel, les visiteurs et les prestataires externes est maintenu.

• les mesures sanitaires concernant les rassemblements sont abrogées (notamment, obligation de port du masque, notification et/ou obtention d’une autorisation auprès de la Direction de la santé, etc.). De ce fait, le port du masque à l’école est supprimé.

Le port du masque est en revanche conservé dans les transports publics et dans les établissements de soin.

A titre de rappel, le non-respect du port du masque dans les transports publics ainsi que le non-respect d’une mesure d’isolement sont punis d’une amende pénale de EUR 500 à EUR 1.000. Pour ces infractions, des avertissements taxés d’un montant de 300 euros peuvent être imposés par les officiers et agents de police judiciaire de la Police grand-ducale et par les agents de l’Administration des douanes et accises.

• l’obligation de disposer d’un protocole sanitaire dans les centres commerciaux est remplacée par des recommandations générales de mesures barrières et d’hygiène, notamment la recommandation de porter un masque en cas de grande affluence, de respecter les distances et de conserver une bonne hygiène des mains ;
• les mesures sanitaires applicables aux activités sportives, de culture physique, scolaires et culturelles sont abrogées et remplacées par des recommandations générales concernant les mesures d’hygiène et les gestes barrières à adopter, notamment la recommandation de porter un masque en cas de grande affluence de personnes, de respecter les distances et de conserver une bonne hygiène des mains.

La loi est entrée en vigueur le 11 mars 2022, jour de sa publication, et restera en principe applicable jusqu’au 30 juin 2022 inclus.

COVID-19-Gesetzgebung: Gesundheitsschutzmaßnahmen nahezu vollständig aufgehoben

In unserem Newsflash vom 22. Februar_ berichteten wir nach der Verabschiedung des Gesetzes vom 11. Februar 2022 über eine Lockerung der Gesundheitsschutzmaßnahmen, die mit dem Gesetz vom 17. Juli 2020 über Maßnahmen zur Bekämpfung der COVID-19-Pandemie eingeführt worden waren. Im Rahmen dieser Lockerung wurde insbesondere die CovidCheck-Regelung am Arbeitsplatz optional und wurden die Ausgangssperren aufgehoben.

Aufgrund der günstigen Entwicklung der wichtigsten Indikatoren und der epidemiologischen Lage hat der luxemburgische Gesetzgeber diese Maßnahmen durch das Gesetz vom 11. März 2022 (das „Gesetz“) nun erneut gelockert.

Die wesentlichen Änderungen des Gesetzes, sind nachstehend zusammengefasst und betreffen in erster Linie die Aufhebung der CovidCheck-Regelung und die Lockerung der Maskenpflicht:

• die CovidCheck-Regelung am Arbeitsplatz ist ab sofort abgeschafft, mit Ausnahme von Gesundheitseinrichtungen (Krankenhäuser, Seniorenwohnstätten usw.) und deren Mitarbeitenden, wegen der dort hohen Konzentration an durch das Coronavirus besonders gefährdeten Personen. Diesbezüglich ist anzumerken, dass als logische Konsequenz das Verbot von Entlassungen oder Disziplinarmaßnahmen in Bezug auf Arbeitnehmer, die sich weigern, ein gemäß der CovidCheck-Regelung gültiges Zertifikat vorzulegen, ebenfalls abgeschafft wurde.
• die CovidCheck-Regelung, deren Anwendung bisher in Restaurants, Bars, Cafés und Kantinen obligatorisch war, ist ab sofort abgeschafft, und zwar sowohl für die Mitarbeitenden dieser Einrichtungen als auch für ihre Kunden;
• die CovidCheck-Regelung wird ebenfalls in Einrichtungen, die der Öffentlichkeit zugänglich sind, sowie im Rahmen von Versammlungen, Demonstrationen oder Veranstaltungen generell abgeschafft. Grundsätzlich können dann alle Bevölkerungsgruppen wieder empfangen werden – ungeachtet ihres Gesundheitszustands oder Impfstatus;
• die CovidCheck-Regelung in Gesundheitseinrichtungen bleibt bestehen, wird jedoch durch die Umstellung von 3G+ auf 3G gelockert. Dahinter steht die Ansicht des Gesetzgebers, dass „die Tatsache, dass diese Einrichtungen in großer Zahl besonders gefährdete Personen beherbergen, es rechtfertigt, selektiv restriktivere Maßnahmen beizubehalten als für die allgemeine Bevölkerung“ (Gesetzesvorlage Nr. 7971, 7-8). Ferner gelten Menschen mit Behinderungen laut Gesetz nicht mehr als besonders schutzbedürftig, sodass Sektoren, die diese Personengruppe betreffen, jetzt keinen besonderen Beschränkungen mehr unterliegen.

Der Zugang zu Gesundheitseinrichtungen ist daher von nun an auf Personen beschränkt, die nachweisen, dass sie:

• • vor weniger als 270 Tagen die vollständige erste Impfserie abgeschlossen oder eine Auffrischungsimpfung erhalten haben; oder
  • über einen negativen PCR-Test verfügen, der nicht älter als 48 Stunden ist, oder über einen zertifizierten COVID-19-Test, der nicht älter als 24 Stunden ist; oder
  • im Besitz eines Genesenen-Nachweises sind, der nicht älter als 180 Tage ist.

Somit ist es in diesen Gesundheitseinrichtungen für geimpfte oder genesene Personen nicht mehr notwendig, vor Ort einen Selbsttest durchzuführen. Dahingegen müssen nicht geimpfte Personen, die nicht über einen Genesenen-Nachweis und/oder eine Bescheinigung über eine Kontraindikation gegen die Impfung verfügen, auch weiterhin einen negativen PCR-Test oder einen negativen zertifizierten COVID-19-Test vorlegen, der vor höchstens 24 Stunden vorgenommen wurde. Alternativ können sie auch vor Ort einen Selbsttest durchführen.

Angesichts der Vulnerabilität der Personen, die sich in der Regel in Gesundheitseinrichtungen aufhalten, wird die Maskenpflicht für dortige Beschäftigte, Besucher und externe Dienstleister beibehalten.

• die Gesundheitsmaßnahmen in Bezug auf Versammlungen werden aufgehoben (darunter die Maskenpflicht sowie die Pflicht zur Anmeldung und/oder Einholung einer Genehmigung beim Gesundheitsamt). Dementsprechend wird die Maskenpflicht auch in den Schulen abgeschafft.

In öffentlichen Verkehrsmitteln und in Gesundheitseinrichtungen wird die Maskenpflicht hingegen beibehalten.

Zur Erinnerung: Die Nichtbeachtung der Maskenpflicht in öffentlichen Verkehrsmitteln sowie die Nichtbeachtung von Isolationsmaßnahmen werden mit einer Geldstrafe von 500 bis 1.000 Euro belegt. Derartige Verstöße können von den Beamten und Hilfsbeamten des Justizpolizeidienstes der Großherzoglichen Polizei sowie der Zoll- und Verbrauchssteuerbehörde mit gebührenpflichtigen Verwarnungen in Höhe von 300 Euro geahndet werden.

• die Verpflichtung, in Einkaufszentren einem Verfahren zum Schutz der Gesundheit zu folgen, wird durch allgemeine Empfehlungen für Barriere- und Hygienemaßnahmen ersetzt – wie etwa die Empfehlung, bei großen Menschenansammlungen eine Maske zu tragen, Abstand zu halten und auf effektive Handhygiene zu achten.
• die Gesundheitsschutzmaßnahmen für Sport, Fitnesseinrichtungen, Schulen und kulturelle Aktivitäten werden aufgehoben und ersetzt durch allgemeine Empfehlungen zu Hygienemaßnahmen und persönlichen Schutzmaßnahmen. Diese umfassen insbesondere die Empfehlung, bei großen Menschenansammlungen eine Maske zu tragen, Abstand zu halten und auf effektive Handhygiene zu achten.

Das Gesetz ist am 11. März 2022 – dem Tag seiner Veröffentlichung – in Kraft getreten und gilt grundsätzlich bis einschließlich zum 30. Juni 2022.
