On 14 May 2024, ESMA released its final report on the guidelines on funds’ names using ESG or sustainability-related terms, which also include a minimum investment threshold and qualifying criteria for different categories of ESG- and sustainability-related terms.

ESMA published three Q&As clarifying key aspects of the practical application of the Guidelines on funds' names using ESG or sustainability-related terms, namely (i) the treatment of green bonds, (ii) the concept of “meaningfully investing in sustainable investments” and (iii) the definition of “controversial weapons”.

Although SFDR has applied from 10 March 2021 and its level II rules from 1 January 2023 many practical points remain, to this date, unclear.
