​On 23 July 2015, a new law concerning the reform of social dialogue (hereafter the “Law”) was enacted which profoundly impacts staff representation within companies.

Effective from 1 January 2016, the Law provides for various important changes to the rules governing the staff delegation, in particular as regards the scope of action provided to the staff delegation. Staff delegates will benefit, inter alia, from increased paid leave to fulfil their duties as staff delegates, from increased opportunities to seek the assistance of external counsellors and of experts and from an increased number of training hours.

Effective in 2018, the Law aims at abolishing the works council and transferring the works council’s competencies to the staff delegation in undertakings employing at least 150 employees.
