VAT - Indirect Taxation

Comprehensive VAT expertise for Europe and beyond

Our highly experienced VAT team provides individual advice to local and international clients on VAT and other indirect taxes, whether domestic or cross-border, support in VAT disputes and litigation, and VAT compliance services.

We provide the following services to clients including financial institutions and investment banks, private equity and real estate funds, pension funds, sovereign wealth funds, insurance and reinsurance companies and multinational corporations, as well as domestic businesses and start-ups.

Indirect tax advice

Our advisory services cover all areas of indirect taxation, including bespoke advice on the conception and development of VAT-efficient structures for corporate and financial transactions, as well as general advice on major business and financial dealings, investment fund structures, mergers and acquisitions, corporate reorganisation, private equity deals and real estate transactions.

Armed with a thorough understanding of the asset management sector, our VAT lawyers and advisors are regularly involved in all types of structuring, assessing the VAT impact on service and fee flows, identifying potential risks and exposure, optimising the input VAT recovery right, and proposing innovative solutions to limit VAT leakage.

We also provide VAT advice in the fields of insurance, executive compensation, electronic services, crypto-currencies and cross-border supply chains, as well as assisting clients regarding customs regimes and procedures.

In an increasingly complex international tax environment, our VAT experts design and implement cross-border solutions in collaboration with tax advisors abroad. Our aim is to provide integrated and seamless services in close co-operation with colleagues from our direct tax and other practice areas, especially for complex and challenging transactions.

VAT compliance

Compliance plays a major role in any company’s VAT management strategy. In addition to its function in determining and reporting due taxes, it also serves as a starting point and factual basis for all queries and audits conducted by the VAT authorities. Proper management of VAT compliance obligations is therefore essential for all businesses in order to minimise the risk of challenges by the authorities.

Our range of VAT compliance services includes:

  • Analysis of the requirement or benefits to be VAT-registered in Luxembourg.
  • Completion and filing of VAT registration requests (simplified or normal regime) and compiling any required documentation.
  • Follow-up of registration requests with the VAT authorities.
  • Preparation of monthly, quarterly and annual VAT returns.
  • Review of VAT returns.
  • Preparation of Intrastat returns and European Sales Lists.
  • Verifying data reporting and reconciliation.
  • Support during audits by the VAT authorities.
  • Liaising and follow-up with the Luxembourg VAT authorities.

Indirect tax litigation

If VAT conflicts arise, our lawyers can advise and represent our clients during all phases of disputes. Our services include assistance during VAT audits, the filing of appeals against binding VAT assessments, and involvement in litigation at all levels from the District Court (Tribunal d’arrondissement) to the European Court of Justice.

In Luxembourg and beyond

With the introduction of VAT in the Gulf Cooperation Council countries, our recognised expertise and in-depth experience in the VAT field can provide our clients with top-quality added value services through a local presence close to our clients' business activities.
